1. Agreement
These Terms of Service govern your use of the website ilsmtc.com and any freight-forwarding, customs, warehousing, or supply-chain service provided by ILS International Logistics Services ("ILS", "we", "us"). By using our website or engaging us to move cargo, you accept these Terms.
2. Our services
ILS acts as a freight forwarder, customs broker, and logistics service provider. We arrange the transport, clearance, and storage of cargo through our network of airlines, ocean carriers, road carriers, and customs authorities. We do not act as the carrier ourselves unless explicitly stated in writing.
3. Standard trading conditions
Unless agreed otherwise in writing, all services are provided subject to standard trading conditions consistent with the FIATA Model Rules and applicable UAE law. Liability is limited to the values defined in the underlying transport conventions (Montreal, Warsaw, Hague-Visby, CMR) and any cargo insurance you have arranged.
4. Quotations and bookings
- Quotations are valid for 7 days unless otherwise stated, and are subject to space and rate availability at the time of booking.
- Quotations exclude duties, taxes, demurrage, detention, and any cost arising from delays, regulatory holds, or events outside our reasonable control.
- A booking is only confirmed once we issue a written booking confirmation.
5. Your obligations
To allow us to move your cargo legally and safely, you agree to:
- Provide accurate descriptions, weights, dimensions, HS codes, and values for all cargo.
- Declare any dangerous, perishable, restricted, or high-value goods before booking.
- Provide all required commercial and regulatory documents in a timely manner.
- Not ship any cargo prohibited by law, sanctions, or airline/carrier regulations.
- Pay our invoices in accordance with the agreed payment terms.
6. Payment
Unless otherwise agreed, payment is due before release of cargo or as stated on the invoice. Late payment may accrue interest at 1.5% per month or the maximum rate permitted by law, whichever is lower. We reserve the right to exercise a lien over any cargo in our possession to secure unpaid invoices.
7. Liability
Subject to mandatory law:
- Our liability for loss or damage to cargo is limited to the amounts set by the applicable transport convention (e.g. 22 SDR/kg for Montreal Convention air freight, 2 SDR/kg or 666.67 SDR per package under Hague-Visby ocean freight).
- We are not liable for consequential, indirect, or economic loss including loss of profit, market, or production.
- Where cargo insurance is not arranged with us, the risk lies entirely with you.
8. Force majeure
We are not liable for delays or non-performance caused by events outside our reasonable control — including but not limited to war, civil unrest, strikes, port closures, customs delays, severe weather, pandemics, sanctions, cyber incidents, and acts of any government.
9. Confidentiality
We treat all customer documents, rates, and commercial information as confidential. Information is shared only with the parties required to perform the contracted services (carriers, brokers, regulators), and only to the extent necessary.
10. Governing law
These Terms are governed by the laws of the United Arab Emirates. Disputes are subject to the exclusive jurisdiction of the Dubai courts, without prejudice to any mandatory arbitration provision in an underlying booking confirmation.
11. Changes
We may update these Terms from time to time. The current version is always available at this URL and the "Last updated" date will reflect any change.
